Terms and conditions for the IT hardware buyback

§1 Scope

These terms and conditions govern the IT hardware buyback by Ecobro and Ferry Telecom AG, including offer, shipping, inspection and payout.

§2 Contracting parties, conclusion of contract and buyback process

2.1 Contracting parties

The purchase contract is concluded between you as the seller and Ferry Telecom AG as the buyer.

2.2 Buyback process

To sell us your used device or IT hardware components, you provide correct and truthful information. We require your first and last name, your address and the details required for payout. If PayPal is selected as the payout method, the seller bears any transaction fees.

2.3 Preliminary purchase value

Based on your information, a preliminary purchase value or an individual offer may be prepared. The validity period stated in the offer must be observed.

2.4 Your offer to us

If you agree with our offer and send in the goods, you are offering us the items for purchase. Final acceptance takes place after receipt and inspection of the goods.

2.5 Inspection of your items and value assessment

After your goods arrive, they are inspected for condition, functionality and consistency with the information provided. The final value assessment is based on this inspection.

2.6 Acceptance of your offer

We are not obliged to accept your offer. If the assessed value matches the agreed value, we accept the offer and arrange payout. If the assessed value is higher, acceptance may take place at the higher value. If the assessed value is lower, we may send a counter-offer. In the event of non-acceptance, the goods are returned in line with the agreed procedure.

2.7 Multiple devices

You may send several items in one shipment if this was agreed in advance or stated in the enquiry.

§3 Shipping conditions, transport risk and transport damage

3.1 Packaging

The items must be packed carefully to avoid transport damage. Use sturdy cardboard boxes and suitable cushioning materials.

3.2 Shipping risk

Shipping is at your own risk. This covers both loss and damage during transport, unless otherwise agreed.

§4 Payment

After acceptance of your offer, payment is made following receipt and inspection of the goods via the agreed payment method. The risk of incorrect transfers due to inaccurate details lies with the seller. Any costs of international transfers are borne by the seller.

§5 Special obligations of the seller

5.1 Ownership and third-party rights

With your offer, you confirm that you are the lawful owner of the items and that they are free of third-party rights.

5.2 Passwords and personal data

Passwords, account locks or device management that prevent inspection or reuse must be removed. Personal data must be backed up and deleted before shipping. We accept no liability for data that has not been backed up or deleted and are entitled to delete any remaining data as part of the agreed processing.

§6 Contract language and storage of the contract text

The contract language is English. Offer data and communication may be stored in accordance with statutory retention obligations.

§7 Miscellaneous provisions

7.1 Written form

Amendments to these terms require the agreed form.

7.2 Governing law and place of jurisdiction

Swiss law applies. The place of jurisdiction for disputes is, to the extent legally permissible, 6203 Sempach.

§8 Image rights and use

Unless stated otherwise, the images and graphics used on this website are protected by copyright and are the property of Ferry Telecom AG. Any reproduction, editing, publication or commercial use is only permitted with prior written consent.
